ORDINANCE NO. 3702
AN ORDINANCE AMENDING ORDINANCE NO. 3652 OF THE CITY OF BESSEMER, ALABAMA, BY AMENDING SECTION FOURTEEN (b) TO ADD SUBSECTION (4) REGARDING PUBLIC COMMENT DURING CITY COUNCIL MEETINGS
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BESSEMER, ALABAMA, that Ordinance Number 3652 is hereby amended as follows:
SECTION 1. Amendment. Ordinance No. 3652, Section Fourteen (b), is hereby amended to add a new subsection (4), which shall read as follows:
(4) The public comment portion of City Council meetings is intended to receive comments regarding matters within the jurisdiction of the City Council. Campaign speeches, electioneering, solicitation of votes or campaign contributions, and the distribution of campaign materials are prohibited during City Council meetings. This restriction shall apply equally to all candidates for public office and shall be administered in a reasonable, viewpoint-neutral manner consistent with applicable federal and state law governing limited public forums.
SECTION 2. Severability. Should any section, subsection, sentence, clause, phrase, or provision of this Ordinance be declared unconstitutional or otherwise invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance, which shall remain in full force and effect.
SECTION 3. Repealer. All ordinances or parts of ordinances in conflict with this Ordinance are hereby repealed to the extent of such conflict.
SECTION 4. Effective Date. This Ordinance shall become effective immediately upon its adoption and publication as required by law.
