A Perry County woman is suing Family Dollar Stores of Alabama, LLC, claiming she bit into a piece of metal in a bag of rice she bought at Family Dollar in Uniontown, according to a complaint filed Oct. 20 in Perry County District Court.
Delois Wilson says in the complaint that she bought a bag of Chestnut Hill Long Grain Rice at the Uniontown Family Dollar on or about Sept. 27 and cooked it later that day according to the directions on the bag. When she began to eat, the complaint states, she felt a stinging sensation on her tongue and bit down on a hard object.
She spit out the rice, and “a small piece of metal with red paint” landed on her plate. She checked her tongue in a mirror, saw blood and kept the metal that had cut her tongue, the complaint says.
The complaint alleges the rice was contaminated through the negligence of the defendants, their employees or agents, and that Wilson was made physically ill, suffered pain, emotional distress and mental anguish, and had a sore tongue for more than a week and a sore jaw from biting down on the metal.
It describes Family Dollar Stores of Alabama as a manufacturer or distributor of food products sold in Family Dollar stores in Alabama and also names two fictitious defendants, “A” and “B,” to be substituted once identified, whose conduct allegedly caused or contributed to her injuries.
Wilson asks for a judgment that would fully compensate her, not to exceed the court’s $20,000 jurisdictional limit. She is represented by Sebie G. Sellers of Gibbs & Sellers, P.C. of Demopolis.
