A 51-year-old Pleasant Grove man is charged with two counts of capital murder in the Sept. 8 shooting death of a Birmingham man in the city’s Roosevelt neighborhood.
Derrick Rasard Gray was arrested the day of the shooting by the Birmingham Police Department’s Violent Crime Apprehension Team in the 2200 block of Third Street Northwest and was taken into custody without incident, police said.
Officers were called to the 5900 block of Jesse Owens Avenue shortly after 6:20 p.m. on a report of a person shot and found Brian Swain, 54, of Birmingham, unresponsive with an apparent gunshot wound. He was pronounced dead at the scene by Birmingham Fire and Rescue. Investigators said Swain and another man had been in a verbal argument before shots were fired.
Police said Gray was arrested on charges of capital murder and shooting into an occupied dwelling and would be held without bond at the Jefferson County Jail. District court records for the Bessemer Division of Jefferson County list two capital murder charges against Gray.
