LEGAL NOTICE

MORTGAGE FORECLOSURE SALE. Default having been made in the payment of the indebtedness secured by that certain mortgage executed by Robert Taylor and Bertha Taylor, husband and wife, originally in favor of Jim Walter Homes, Inc, on January 27, 2006, said mortgage recorded in the Office of the Judge of Probate of Hale County, Alabama, in Mtg 3455 Page 214; the undersigned The Bank of New York Mellon, as Indenture Trustee, for Mid-State Capital Corporation 2006-1 Trust, as Mortgagee/Transferee, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash, in front of the main entrance of the Courthouse at Greensboro, Hale County, Alabama, on September 30, 2026, during the legal hours of sale, all of its rights, title, and interest in and to the following described real estate, situated in Hale County, Alabama, to-wit:

A parcel of land lying in the Southwest Quarter of the Southeast Quarter of Section 8, Township 20 North, Range 5 East, Hale County, Alabama, and being more particularly described as follows:

Commence at the Southeast corner of Section 8, Township 20 North, Range 5 East, Hale County, Alabama; thence run in a Westerly direction along the South boundary of said Section 8 for a distance of 1538.20 feet to a point; thence, with a defection angle right of 64 degrees 00 minutes, run in a Northwesterly direction for a distance of 785.69 feet to an iron rod and the Point of Beginning; thence, with an angle right of 118 degrees 13 minutes, run in a Westerly direction for a distance of 210.97 feet to an iron rod; thence, with an interior angle left of 100 degrees 13 minutes, run in a Northerly direction for a distance of 213.63 feet to an iron rod; thence, with an interior angle left of 81 degrees 04 minutes, run in an Easterly direction for a distance of 210.00 feet to an iron rod on the West Right-of-Way margin of Gem Drive (Lake Road) (60 Rightof-Way); thence run along the West right-of-way margin of said Gem Drive as follows: with an interior angle left of 94 degrees 46 minutes, run in a Southerly direction for a distance of 83.67 feet to a point; thence, with an interior angle left of 190 degrees 55 minutes, run in a Southeasterly direction along a curve to the left for a chord distance of 95.04 feet to a point; thence leaving said Rightof-Way margin, with an interior angle left of 166 degrees 21 minutes, run in a Southerly direction for a distance of 40.88 feet to the Point of Beginning, forming an interior closure angle of 86 degrees 41 minutes, all lying in the Southwest Quarter of the Southeast Quarter of Section 8, Township 20 North, Range 5 East, Hale County, Alabama, and containing 1.02 acres, more or less..

This sale is made for the purpose of paying the indebtedness secured by said mortgage, as well as the expenses of foreclosure. The successful bidder must tender certified funds in the amount of the winning bid made payable to Tiffany & Bosco, P.A. at the time and place of the sale.

The sale will be conducted subject to: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, (2) final confirmation with the Mortgagee/Transferee, and if applicable, (3) collection of purchaser information needed to comply with the reporting requirements under the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R. Part 1031) and reimbursement of any fees and expenses incurred as a result of the collection of such information.

The Mortgagee/Transferee and Tiffany & Bosco, P.A shall not be liable for any damages whatsoever. If the sale is set aside for any reason, the purchaser at the sale shall be only entitled to a return of the bid amount.

The Mortgagee/Transferee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.

This sale is subject to postponement or cancellation.
